DISPUTE RESOLUTIONThe need to resolve disputes has increased at an exponential rate as our social and economic environment has become more divisive and contentious. That need is being met, in part, by development of formal procedures involving trained and experienced individuals to serve as Mediators and/or Arbitrators. For certain judicial functions, the Florida Supreme Court has instituted certification programs to establish minimum standards for moral character, education, and training of Mediators. The mediation program is an attempt to resolve the
differences, by consensus, between two parties in an atmosphere of
confidentiality and discussion, impartially managed by a certified
Mediator acting as a neutral third party. Arbitration is a more structured
arrangement where the Arbitrator, acting in the third party role, is
empowered to influence the outcome of negotiations between disputing
parties.
